Terms & Conditions

Article 1 — Company details

Trading name: Marble City
Website: xxx
Email: xxx
Company registration (CRO) number: xxx
VAT number: xxx
Registered address: xxx

(← CRO replaces the Dutch KvK number. Bank details removed — see notes. Registered address added: if you trade as a limited company, Irish company law requires it to appear on your website and business correspondence.)

Article 2 — Applicability

  1. These terms apply to every offer made by Marble City and to every contract concluded via xxx.
  2. Before a distance contract is concluded, these terms are made available to the customer, who can save or print them.
  3. These terms may only be departed from where expressly agreed in writing or by email with Marble City.
  4. Nothing in these terms limits or excludes your statutory rights as a consumer under the Consumer Rights Act 2022 or the Sale of Goods and Supply of Services Acts. Where any term conflicts with those rights, your statutory rights prevail. (← added; see notes.)

Article 3 — Offer and contract

  1. Offers on the website are without obligation and may be changed at any time.
  2. A contract is concluded once the customer places an order via the website and Marble City confirms that order by email.
  3. Images on the website are for illustration. With sealed TCG product (boosters, booster boxes, sealed decks), the contents are random and Marble City cannot guarantee any specific cards, hits, or values.
  4. Obvious errors or mistakes in prices or descriptions, such as clear typographical errors, do not bind Marble City.

Article 4 — Prices and payment

  1. All prices on the website are in euro, including VAT and excluding delivery charges, unless stated otherwise.
  2. Delivery charges are shown clearly before the order is completed.
  3. Payment is made using the methods offered during checkout — for example card, PayPal, Revolut, or other online payment methods. (← iDEAL and Bancontact removed; neither is used in Ireland.)
  4. Orders are dispatched only once Marble City has received payment in full.

Article 5 — Delivery and performance

  1. Unless stated otherwise, orders are generally dispatched within one working day of payment being received.
  2. Delivery is made to the address the customer provided during checkout. The customer is responsible for entering these details correctly.
  3. If delivery is delayed, or an order cannot be fulfilled in full, the customer will be informed as soon as possible. The customer may then cancel the contract free of charge for the part not yet delivered, and any amount paid for that part is refunded.
  4. Where no delivery period has been agreed, goods will be delivered within 30 days of the contract being concluded. (← added; this is the statutory default and it needs stating.)
  5. Risk of loss or damage passes to the consumer at the point the order is received by, or on behalf of, the consumer.

Article 6 — Right of withdrawal (consumers)

  1. A consumer who buys a product online has the right to cancel the contract within 14 days of receiving the product, without giving a reason.
  2. During this cooling-off period, the consumer may only handle and inspect the product in the way that would be permitted in a physical shop.
  3. To exercise this right, the consumer must inform Marble City by email or another clear statement within 14 days of receiving the product.
  4. After giving that notice, the consumer has a further 14 days to return the product.
  5. The direct cost of returning the product is borne by the customer, unless expressly stated otherwise.

Specific to TCG product

  1. The consumer may open the shipping box and unpack the product in order to inspect it.
  2. Sealed product should be returned unopened. Opening a sealed product goes beyond what is necessary to establish its nature and characteristics.
  3. Where the seal on a sealed product has been broken after delivery, Marble City will assess the resulting reduction in value and deduct it from the refund. Because opened product cannot be resold as sealed, this deduction may amount to the full value of the item. (← rewritten from the original’s flat “100% reduction in value, no refund”. Same issue as in the returns policy — see notes.)
  4. Singles must be returned in the same condition in which they were delivered. Damage arising after delivery may reduce the amount refunded.

Article 7 — Returns and refunds

  1. Returns must first be registered with Marble City by email. The customer then receives further instructions, including the return address.
  2. Marble City refunds the purchase price of the returned product, including the standard outbound delivery charge, within 14 days of the notice of withdrawal. Marble City may withhold the refund until the product has been received, or until the customer demonstrates that it has been sent back.
  3. Where only part of an order is returned, the delivery charge is refunded only if the entire order is withdrawn, unless stated otherwise.
  4. Where a reduction in value has arisen because the product was handled beyond what was necessary to assess it, as described in Article 6, that reduction may be deducted from the refund.

Article 8 — Pre-orders

  1. A pre-order is an order for a product that is not yet in stock and can only be delivered after its official release date.
  2. Pre-orders require payment in full in advance, unless stated otherwise.
  3. Each pre-order product page states the expected release date. Release and delivery dates given are indicative and may be changed by the publisher or manufacturer, or by logistical circumstances. (← the requirement to state an expected date is added; the original gave no date at all.)
  4. Delay does not give rise to a right to compensation, but where there is significant delay the customer may cancel the pre-order and the amount paid will be refunded. This does not affect the consumer’s statutory right to cancel where goods are not delivered within an agreed or reasonable period. (← qualifier added.)
  5. If a pre-order ultimately cannot be delivered — for example because the supplier cancels or under-allocates — the contract is dissolved and the customer is refunded.
  6. The statutory right of withdrawal applies to pre-orders as it does to any other order. The consumer may withdraw within 14 days of receiving the product, as described in Article 6, and may also tell Marble City before delivery that they no longer wish to proceed.

Article 9 — Conformity and guarantees

  1. Marble City warrants that the products delivered conform to the contract, to the characteristics described in the offer, and to the customer’s reasonable expectations.
  2. For sealed TCG product, Marble City guarantees that it is genuine, unopened, and from the set or release stated. The actual cards pulled from a product are outside Marble City’s control and give no right to replacement or refund if the contents disappoint.
  3. Singles are described as accurately as possible using the condition grades standard in the TCG trade — Near Mint, Lightly Played, and so on. Small differences in assessment can occur.
  4. We ask customers to check their order on receipt and to report any visible defects or concerns about card condition by email as soon as reasonably possible, ideally within seven days. This is a request that helps us resolve issues quickly. It does not limit your statutory rights, which run for up to six years. (← significantly changed from the original, which made seven days a condition. See notes.)
  5. Where a product does not conform to the contract, you are entitled to a repair or replacement within a reasonable time and without significant inconvenience. Where that is not possible or not done, you may be entitled to a price reduction or a refund. In the first 30 days you may also have the right to reject the goods and obtain a full refund. (← rewritten to reflect the statutory remedy hierarchy rather than leaving the choice of remedy with the seller.)

Article 10 — Complaints

  1. Complaints about the performance of the contract can be submitted by email to xxx. Please describe the complaint as clearly as possible and attach photographs where relevant.
  2. Marble City responds within 14 days of receiving a complaint. If more time is needed, the customer will receive notice within 14 days indicating when a substantive response will follow.
  3. If a complaint cannot be resolved between us, the consumer may bring the matter before the competent courts, or seek advice from the Competition and Consumer Protection Commission (ccpc.ie). Consumers in another EU member state can contact the European Consumer Centre Ireland (eccireland.ie). (← replaces the Dutch juridisch loket. See notes about what NOT to add here.)

Article 11 — Liability

  1. Marble City is not liable for indirect loss, consequential loss, or loss of profit, except in cases of intent or gross negligence.
  2. Marble City’s liability is in all cases limited to the value of the order concerned, except where mandatory law provides otherwise.
  3. Nothing in this article excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded. Nor does it limit your statutory rights as a consumer. (← added. Without this carve-out the whole article risks being struck out as an unfair term.)

Article 12 — Disputes and governing law

  1. All contracts between Marble City and the customer are governed by Irish law.
  2. Disputes may be brought before the competent courts in Ireland. Where the customer is a consumer resident in another EU member state, they retain the right to bring proceedings in the courts of their own country, and to the protection of any mandatory consumer law of that country. (← both points changed from Dutch law and Dutch courts. The second sentence is not optional if you ship into the EU.)

Article 13 — Privacy

  1. Marble City handles personal data carefully and processes it in accordance with applicable data protection law, including the GDPR and the Data Protection Act 2018.
  2. The privacy statement at xxx sets out what personal data is collected, the purposes for which it is used, and what rights customers have.
  3. The privacy statement is available on the Marble City website.
